Welcome to Everdream Funding. These Terms explain the rules and conditions that apply when you use our website and services. Please read them carefully, especially the provisions regarding independent funding providers, communications, disclaimers, and limitations of liability.

1. Acceptance of These Terms

These Terms & Conditions ("Terms") govern your access to and use of the Everdream Funding website, online forms, educational content, appointment scheduling, communications, and related services (collectively, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

"Everdream Funding," "we," "us," and "our" refer to the Everdream Funding brand and its legal operating entity, identified in Section 22. If you use the Services on behalf of a business, you represent that you are authorized to act for that business.

You must be at least 18 years old and legally capable of entering into binding agreements to use the Services.

2. What We Do — and Do Not Do

Everdream Funding provides business funding information, educational resources, preliminary intake, application assistance, and introductions or referrals to independent funding providers. We may also offer referrals to independent credit-improvement or credit-repair service providers where appropriate and authorized.

Any descriptions of potential funding amounts, timelines, eligibility, or rates are informational estimates, not offers, commitments, or guarantees. Actual availability depends on provider requirements and your circumstances.

3. Funding Inquiries, Applications, and Authorization

You agree to provide accurate, current, complete information and to update it when reasonably requested. You represent that you are authorized to submit business and ownership information and to request assistance on behalf of the identified business.

At your request, we may use the information you provide to assess preliminary suitability and facilitate an introduction or application with an independent provider. The provider may request additional documentation, identity verification, or separate consents.

Submitting an inquiry or using this website does not, by itself, authorize a credit report inquiry. Any consumer or business credit inquiry must be conducted only with the authorization or other legal basis required by applicable law. A provider may conduct a soft or hard inquiry if separately disclosed and lawfully authorized.

You are responsible for reviewing all offers, disclosures, costs, repayment obligations, and agreements before accepting financing.

4. Independent Providers and Referral Compensation

Funding providers, credit-repair providers, and other referral partners are independent businesses. Their products, qualifications, fees, terms, privacy practices, communications, and performance are their own responsibility. We do not control their decisions or guarantee their services.

We may receive referral fees, commissions, or other compensation when we introduce eligible customers to certain providers. Compensation arrangements may influence which providers we work with or present, but do not guarantee that a particular offer is available or suitable for you.

Where you request or authorize a referral, we may share information reasonably needed to make that referral, consistent with our Privacy Policy. A referral does not transfer your consent to receive Everdream Funding marketing text messages to a partner; partners are responsible for obtaining any consent they independently require.

5. Credit-Repair and Related Referrals

If you ask us to connect you with a credit-repair or credit-improvement provider, we may transmit relevant information to an independent partner through a secure referral process, including an API or webhook. The partner is solely responsible for describing its services, eligibility, fees, contracts, and legally required disclosures.

Everdream Funding does not promise a particular credit-score increase, removal of accurate credit information, funding approval following credit repair, or any specific result. You are not required to purchase credit-repair services to contact us about funding.

6. No Financial, Legal, Tax, or Credit Advice

Website content, examples, funding estimates, calculators, AI-generated responses, and educational materials are for general informational purposes only. They are not individualized financial, investment, legal, tax, or credit advice. You should consult appropriately qualified independent professionals before making material financial decisions.

Testimonials, case studies, or examples describe individual experiences and do not establish typical outcomes or guarantees of future results.

7. Communications and SMS Messaging

We may communicate with you by email, telephone, website chat, and text message about inquiries, appointments, application updates, support, and, where you have separately opted in, promotional content.

SMS consent is optional and not a condition of purchasing or receiving services. Marketing texts are sent only where we have obtained the consent required by applicable law. Message frequency varies. Carriers are not liable for delayed or undelivered messages.

Opting out of promotional texts does not necessarily prevent nonmarketing communications that are otherwise lawful and necessary to respond to a request or administer an existing relationship. Consent and opt-out practices are further described in our Privacy Policy.

8. Electronic Communications and Signatures

When you submit forms, contact us electronically, or use online scheduling, you agree that we may respond electronically. Where legally permitted, electronic notices and records may satisfy writing requirements. Any separate electronic signature or transaction consent will be obtained as required by applicable law.

These Terms do not by themselves obligate you to enter into a loan, purchase a product, or accept electronic delivery of disclosures where separate consent is legally required.

9. Artificial Intelligence and Automated Tools

We may use AI-assisted chat, automated workflows, and software tools to answer general questions, organize inquiries, provide preliminary information, and help route requests. Automated outputs can be incomplete, outdated, or inaccurate and should not be relied on as a final determination of financing eligibility or terms.

Do not submit passwords, full payment-card details, or other unnecessary highly sensitive information through a public chat interface. We may review and correct automated communications as appropriate. Our handling of personal information is described in our Privacy Policy.

10. Acceptable Use and User Representations

You agree not to misuse the Services, impersonate others, submit false or unauthorized applications, infringe intellectual-property rights, transmit malware, attempt unauthorized access, interfere with operations, harvest personal information, or use automated scraping or bulk submissions without permission. You may not use the Services in violation of law or to facilitate fraud or other unlawful conduct.

We may investigate suspected misuse and restrict access when reasonably necessary to protect users, providers, our systems, or legal rights.

11. Intellectual Property and Permitted Use

The website's design, text, graphics, branding, logos, educational materials, and other content are owned by or licensed to Everdream Funding and protected by applicable law. Subject to these Terms, we grant you a limited, nonexclusive, revocable right to view and use the Services for your personal use or legitimate internal business purposes.

You may not reproduce, republish, distribute, sell, or commercially exploit our content or branding without prior written permission, except as permitted by law.

12. Information and Feedback You Submit

You retain ownership of materials you submit, subject to any rights held by others. You grant us a limited right to host, process, transmit, and use submitted information as reasonably necessary to provide requested Services, maintain records, comply with law, and fulfill purposes described in our Privacy Policy.

If you voluntarily provide ideas or feedback about improving our Services, you permit us to use that feedback without compensation, subject to applicable law. Do not submit materials you lack authority to share.

13. Testimonials and Reviews

If we offer a way to submit a testimonial or review, you agree that it will reflect your genuine experience and will not be unlawful, misleading, defamatory, infringing, or abusive. We may moderate or remove content where lawful.

We will obtain any permissions required to publicly use your name, likeness, or testimonial and will disclose material connections where required by law. We do not guarantee that any review or testimonial reflects typical outcomes.

14. Third-Party Sites and Services

Our Services may link to third-party websites, portals, applications, or documents. We are not responsible for their content, availability, security, policies, or separate agreements. Links do not necessarily indicate endorsement. Review each third party's terms and privacy notices before sharing information or accepting a product or service.

15. Privacy and Data Handling

Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information, including information used for funding and credit-repair referrals, analytics, and communications. The Privacy Policy is a separate notice and does not reduce rights you may have under applicable privacy law.

16. Availability, Changes, and Suspension

We may update, correct, improve, suspend, or discontinue features of the Services. We do not promise uninterrupted access or error-free operation. We may suspend or restrict access for security reasons, suspected fraud, violations of these Terms, or legal requirements.

We may revise these Terms from time to time. The updated version will show a revised effective date. Where required by law or appropriate for material changes, we will provide additional notice. Changes will apply prospectively to the extent required by law.

17. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND INFORMATIONAL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT INFORMATION, FUNDING ESTIMATES, REFERRALS, OR THIRD-PARTY OFFERS WILL BE ACCURATE, AVAILABLE, OR SUITABLE FOR YOUR NEEDS. NOTHING IN THESE TERMS EXCLUDES WARRANTIES OR RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EVERDREAM FUNDING AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, BUSINESS OPPORTUNITIES, OR DATA, ARISING FROM THE SERVICES, EVEN IF ADVISED SUCH DAMAGES WERE POSSIBLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIRECTLY TO US FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS BEFORE THE EVENT OR (B) US $500.

THESE LIMITATIONS DO NOT APPLY TO THE EXTENT PROHIBITED BY LAW, INCLUDING TO LIABILITY THAT CANNOT LEGALLY BE LIMITED OR EXCLUDED. INDEPENDENT PROVIDERS ARE RESPONSIBLE FOR THEIR OWN CONTRACTS AND SERVICES.

19. Indemnification

To the extent permitted by law, if your unlawful conduct, material breach of these Terms, or infringement of another person's rights causes a third-party claim against us, you agree to indemnify and hold harmless Everdream Funding and its representatives from reasonable resulting losses, liabilities, and expenses, including reasonable attorneys' fees. This provision does not require you to indemnify us for our own negligence, misconduct, or violations of law where prohibited.

20. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where mandatory laws provide otherwise.

Informal resolution: Before filing a lawsuit arising from these Terms, you and we agree to make a good-faith effort to resolve the dispute by written notice and informal discussion for 30 days, unless urgent relief is necessary or law prohibits such a requirement. Notices may be sent to legal@everdreamfunding.com or the mailing address in Section 22.

Courts and venue: Unless applicable law requires otherwise, disputes that cannot be resolved informally may be brought in a court of competent jurisdiction in Texas. Any specific venue must be legally proper for the dispute.

21. General Provisions

If any provision of these Terms is held unenforceable, the remaining provisions will remain effective to the extent permitted by law. Our failure to enforce a provision is not a waiver. We may assign these Terms in connection with a lawful business transfer. Neither party is liable for delay caused by events beyond reasonable control, except for obligations that cannot legally be excused.

These Terms, together with any separate written agreement applicable to a particular service, govern your use of the Services. If a separate signed agreement conflicts with these website Terms concerning that service, the separate agreement controls to the extent of the conflict. No partnership, agency, employment, or joint venture is created by your use of the website.
